Terms of Service

Please read these terms carefully before using yenrealty.ca.
These Terms of Service govern your use of yenrealty.ca and all associated services, operated by Les Immeubles Charisma Inc. (trade name: Yen Realty), a real estate brokerage licensed by OACIQ, with offices at 3310, 100e Avenue, Suite 340, Laval, QC H7T 0J7, Canada.
1. Acceptance of Terms
By accessing or using the yenrealty.ca website and any services offered through it (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree with any of these Terms, you are prohibited from using or accessing this Platform.
You must be at least 18 years of age to use this Platform. By using the Platform, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into a binding agreement. If you are accessing the Platform on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
These Terms constitute a legally binding agreement between you and Les Immeubles Charisma Inc. ("we," "us," or "our"), operating under the trade name Yen Realty.
2. Description of Services
The Platform provides the following services:
Real Estate Brokerage Services: Yen Tran Tran is a licensed real estate broker operating under Les Immeubles Charisma Inc., a brokerage duly licensed by the Organisme d'autoréglementation du courtage immobilier du Québec (OACIQ). All real estate brokerage activities are conducted in compliance with the Real Estate Brokerage Act (LCCQ) and OACIQ regulations.
Residential Cleaning Services: The Platform facilitates connections between clients and independent cleaning service providers for residential and commercial cleaning in the Greater Montreal area.
AI-Powered Tools: The Platform offers AI-assisted features including feng shui property analysis, neighbourhood market insights, listing descriptions, and property valuation estimates. These tools are provided for informational purposes only and do not constitute professional advice.
3. User Accounts
To access certain features of the Platform, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding the password you use to access the Platform and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account. We will not be liable for any loss or damage arising from your failure to comply with this security obligation.
We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, us, third parties, or for any other reason in our sole discretion. Upon termination, your right to use the Platform will immediately cease.
4. Real Estate Services
All real estate brokerage services are provided by Yen Tran Tran, a broker acting under the licence of Les Immeubles Charisma Inc., OACIQ licence number as displayed in the footer of this Platform. All activities are governed by the Real Estate Brokerage Act and OACIQ's Code of Ethics and professional rules.
No guarantee of outcomes: Engaging a broker through this Platform does not guarantee the sale, purchase, rental, or any other outcome of a real estate transaction. Market conditions, property characteristics, and other factors outside our control affect transaction results.
Commission and fees applicable to any real estate transaction will be disclosed in the brokerage contract signed by both parties prior to the commencement of services, in accordance with OACIQ requirements.
Dual Agency: In situations where Les Immeubles Charisma Inc. represents both the buyer and the seller in the same transaction, an OACIQ form ADX-1 (Disclosure of Dual Representation) will be provided to and executed by all parties before any negotiation proceeds, as required by law.
5. Cleaning Services
Independent Contractor Status: Cleaning service providers made available through the Platform are independent contractors, not employees or agents of Les Immeubles Charisma Inc. or Yen Realty. We are not responsible for the acts or omissions of these independent contractors beyond facilitating the initial connection and maintaining service standards.
Insurance: All cleaning service providers are required to carry valid liability insurance. Proof of insurance is verified at onboarding. However, we recommend that clients also review their own homeowner's or tenant's insurance coverage.
Cancellation Policy: Cancellations made at least 24 hours before a scheduled cleaning appointment may be cancelled without charge. Cancellations made within 24 hours of the scheduled appointment time will incur a fee equal to 50% of the booked service price. No-shows will be charged the full service price.
Satisfaction Guarantee: If you are not satisfied with a completed cleaning service, you must notify us within 24 hours of service completion. We will arrange a complimentary re-clean of the affected areas within 48 hours, subject to availability. This guarantee applies to the original scope of work and does not cover pre-existing damage, inaccessible areas, or conditions outside the cleaner's reasonable control.
6. Payments & Billing
All payments are processed securely through Stripe, Inc. By providing your payment information, you authorize us to charge the applicable fees to your designated payment method. All transactions are conducted in Canadian dollars (CAD).
Subscription Services: Where subscription plans are offered, your subscription will automatically renew at the end of each billing period unless you cancel at least 48 hours before the renewal date. You will be notified of any changes to subscription pricing at least 30 days in advance.
Refund Policy: Real estate brokerage fees are governed by the signed brokerage contract and applicable OACIQ rules. For cleaning services, refunds for completed services are evaluated on a case-by-case basis. Subscription fees paid for an active billing period are non-refundable except where required by applicable Quebec consumer protection law. Unused cleaning service credits will be refunded upon written request.
Chargebacks: If you initiate a chargeback or payment dispute without first contacting us to resolve the issue, we reserve the right to suspend your account pending resolution.
7. Intellectual Property
All content on this Platform — including text, graphics, logos, photographs, audio and video clips, data compilations, and software — is the property of Les Immeubles Charisma Inc. or its content suppliers and is protected by Canadian copyright, trademark, and other intellectual property laws. Unauthorized reproduction, distribution, modification, or use of any content without express written permission is strictly prohibited.
User-Submitted Content: By submitting any content to the Platform (including reviews, photos, or messages), you grant Les Immeubles Charisma Inc. a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, modify, adapt, publish, and display such content in connection with the operation and promotion of the Platform. You represent and warrant that you own or have the necessary rights to grant this licence and that your content does not infringe any third-party rights.
You may not use our trademarks, trade names, or service marks without our prior written consent.
8. AI-Generated Content
Disclosure: Certain content and analysis provided on this Platform — including feng shui assessments, property listing descriptions, neighbourhood insights, and market analysis — is generated or assisted by artificial intelligence systems. In accordance with Quebec's Act respecting the protection of personal information in the private sector (Law 25) and applicable transparency obligations, such content is clearly identified as AI-generated where it appears.
Not Professional Advice: AI-generated content is provided for informational and illustrative purposes only. It does not constitute professional real estate advice, legal advice, financial advice, architectural advice, or any other form of professional advice. You should not make material decisions based solely on AI-generated content without independent professional verification.
Accuracy: While we strive to ensure the quality of AI-generated content, we make no representations or warranties regarding its accuracy, completeness, or fitness for any particular purpose. Property value estimates, feng shui assessments, and neighbourhood insights are approximations based on available data and algorithmic models, and actual conditions may differ materially.
AI Decision Logging: Automated decisions generated by AI tools on this Platform that may affect users are logged in our AI decision log in accordance with Law 25 obligations. Users may request information about automated decisions that have affected them by contacting us at the address below.
9. Privacy & Data
Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, available at /privacy, which is incorporated into these Terms by reference.
Law 25 / PIPEDA Compliance: We collect and process personal information in accordance with Quebec's Act respecting the protection of personal information in the private sector (Law 25) and the federal Personal Information Protection and Electronic Documents Act (PIPEDA). You have the right to access, correct, and request deletion of your personal information held by us.
CASL Compliance: Any commercial electronic messages sent to you will comply with Canada's Anti-Spam Legislation (CASL). We will only send commercial electronic messages where we have express or implied consent as defined by CASL. All such messages will include our sender identification, physical mailing address, and a functional unsubscribe mechanism that is honoured within 10 business days of receipt.
Data Residency: Personal data processed through AI features on this Platform is handled through infrastructure located in the northamerica-northeast1 region (Montréal, Québec) to the extent practicable, in support of Law 25 data residency considerations.
10. Limitation of Liability
To the maximum extent permitted by applicable Quebec law, Les Immeubles Charisma Inc., its officers, directors, employees, brokers, agents, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, arising out of or in connection with your use of the Platform or the services.
Without limiting the foregoing, we expressly disclaim all liability for: (a) the accuracy of AI-generated content including property value estimates, feng shui assessments, or neighbourhood analyses; (b) the outcome of any real estate transaction; (c) the quality, safety, or results of any cleaning service performed by independent contractors; (d) any unauthorized access to or alteration of your data; or (e) any third-party conduct or content.
Where liability cannot be fully excluded under Quebec consumer protection law or the Civil Code of Québec, our total aggregate liability to you for any claim arising from these Terms or the Platform shall not exceed the greater of (i) the total fees paid by you to us in the three months preceding the claim, or (ii) one hundred Canadian dollars (CAD $100).
Nothing in these Terms limits liability for fraud, gross negligence, or intentional misconduct.
11. Indemnification
You agree to indemnify, defend, and hold harmless Les Immeubles Charisma Inc. and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Platform; (b) your breach of these Terms; (c) your violation of any applicable law or regulation; (d) your violation of any third-party rights, including intellectual property rights or privacy rights; or (e) any content you submit, post, or transmit through the Platform.
We reserve the right, at our own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, and you agree to cooperate with our defence of such claims.
12. Dispute Resolution
Governing Law: These Terms and any disputes arising out of or in connection with them or the Platform shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Jurisdiction: Subject to the mediation provision below, you irrevocably consent to the exclusive jurisdiction and venue of the Superior Court of Quebec, District of Montreal, for the resolution of any dispute arising under or related to these Terms.
Mediation First: Before commencing any formal legal proceeding, both parties agree to attempt to resolve any dispute through good-faith negotiation for a period of 30 days. If negotiation fails, the parties agree to attempt mediation through a mutually agreed mediator in Montreal before proceeding to litigation. The costs of mediation shall be shared equally unless otherwise agreed.
Consumer Rights: Nothing in this section limits any rights you may have under Quebec's Consumer Protection Act or other mandatory consumer protection legislation.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Effective Date" at the top of this page and, where feasible, provide notice via the Platform or by email to registered users.
Your continued use of the Platform after any modification to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue your use of the Platform.
We recommend that you review these Terms periodically. The current version of the Terms will always be available at /terms.
