Canada's Anti-Spam Legislation — How Yen Realty stays compliant

Our Commitment to CASL
Yen Realty, operated by Les Immeubles Charisma Inc., is committed to full compliance with Canada's Anti-Spam Legislation (CASL, S.C. 2010, c. 23). We only send commercial electronic messages (CEMs) to individuals who have given express or implied consent, we always identify ourselves clearly, and we make it easy to withdraw consent at any time. This page explains exactly how we meet each CASL obligation so you can trust every message you receive from us.
Types of Messages We Send
Transactional Messages — no consent required
These messages are necessary to complete a transaction or fulfil a contractual obligation you have already initiated. They include:
- Booking confirmations for property visits or cleaning appointments
- Visit request acknowledgements and scheduling updates
- Payment receipts and invoices
- Account security alerts (password resets, login notifications)
- Service status updates directly related to your booking
Commercial Messages — consent required
These messages promote our real estate or cleaning services and are only sent to individuals from whom we hold valid express or implied consent. They include:
- New listing alerts matching your saved search criteria
- Price drop notifications on properties you have saved
- Cleaning service promotions and seasonal offers
- Monthly real estate market newsletters
- Neighbourhood guide publications
How We Obtain Consent
Express Consent
Express consent is obtained through an explicit, opt-in action — never a pre-ticked checkbox. We collect express consent at the following touchpoints:
- Onboarding flow: an unticked checkbox with the exact text of the consent request displayed beside it
- Booking forms: a separate opt-in for marketing communications, distinct from the booking terms
- Newsletter sign-up: a dedicated subscription form on the website
Every express consent event is logged in our database with: the timestamp of consent, the channel or form through which consent was given, and the exact text of the consent statement shown to the individual. Express consent remains valid until withdrawn.
Implied Consent
Implied consent arises from an existing business relationship or inquiry, as defined under CASL ss. 10(9)–(13):
- Existing business relationship (e.g., a completed transaction, signed listing agreement): implied consent is valid for 2 years from the date of the last transaction
- Inquiry or application (e.g., a property enquiry or contact form submission): implied consent is valid for 6 months from the date of the inquiry
We track implied consent expiry dates and automatically suppress commercial messages once the applicable period has lapsed, unless express consent has been obtained in the interim.
Sender Identification
Every commercial electronic message we send — whether by email or SMS — clearly identifies the sender. You will always see:

This information appears in the footer of every email and in the opt-out instructions included with every SMS message.
Unsubscribe Mechanism
You can withdraw consent and stop receiving commercial messages at any time through any of the following channels:
- Email: click the Unsubscribe link in the footer of any commercial email — this takes you to /api/unsubscribe where your preference is recorded immediately
- SMS: reply STOP to any SMS message from us — your number is removed from all future commercial SMS
- Account settings: log in and update your notification preferences under Settings → Communications
- Email request: send an unsubscribe request directly to yentran24@yahoo.com
All unsubscribe requests are honoured within 10 business days as required by CASL s. 11(3). We will not send you any further commercial electronic messages after your request has been processed.
Record Keeping
We maintain comprehensive consent records to demonstrate CASL compliance. For each consent record we retain:
- The exact timestamp (date and time, UTC) when consent was given
- The method used to collect consent (form name, page URL, SMS keyword, etc.)
- The exact text of the consent statement or disclosure shown to the individual
- The IP address associated with a web-based consent event (where applicable)
- Any subsequent withdrawal of consent and the date it was processed
Consent records are retained for the full duration of the consent period plus an additional 3 years after it expires or is withdrawn, in accordance with regulatory best practices and CASL enforcement guidelines issued by the CRTC.
SMS Communications
CASL applies to SMS messages just as it does to email. When you opt into SMS communications from Yen Realty you will be informed of:
- Message frequency:disclosed at the point of opt-in (e.g., “Up to 4 messages/month”)
- Standard message rates:“Message and data rates may apply” is displayed at opt-in
- STOP keyword: reply STOP at any time to unsubscribe from all SMS messages
- HELP keyword: reply HELP for support contact information
SMS opt-ins are recorded with the same timestamp, method and consent-text logging as email consents. No SMS is sent beyond the frequency disclosed at opt-in.

- The CRTC Spam Reporting Centre accepts reports of suspected CASL violations and can investigate non-compliant senders.
